Article 1: Definitions
1.1. In these general terms and conditions, the following terms are used with the following meanings, unless stated otherwise:
1.2. Unless stated otherwise, singular terms also refer to the plural, and vice versa.
Article 2: Applicability
2.1. These general terms and conditions apply to the legal relationship between RNC Wonen and the Tenant, including but not limited to the Rental Service and Rental Assignment.
2.2. Deviations from these terms are only valid when agreed upon in writing by both parties.
2.3. If a provision in these terms is declared invalid or void, the remaining provisions shall remain in full effect. In that case, the invalid provision will be replaced by a provision that closely approximates the original intent.
2.4. The failure of RNC Wonen to immediately enforce compliance does not mean that RNC Wonen waives its right to demand full compliance at a later time.
Article 3: Registration and Payment for the Rental Service
3.1. The Tenant can register for RNC Wonen's Rental Service upon payment of a one-time fee of €35.00.
3.2. By registering, the Tenant agrees to these general terms and conditions and the processing of personal data as described in RNC Wonen’s privacy policy.
3.3. The registration is valid for one year from the date of receipt of payment. During this period, the Tenant is entitled to: a. Access to the online database of available properties; b. Unlimited viewings of available properties; c. Updates and notifications about new properties that match the Tenant’s preferences.
3.4. After the registration period expires, the rights to access the database and other services will lapse, unless the Tenant re-registers and pays the then-applicable registration fee.
Article 4: Services and Obligations of RNC Wonen
4.1. RNC Wonen will make efforts to find suitable residential properties based on the preferences provided by the Tenant but does not guarantee that a suitable property will be found.
4.2. RNC Wonen uses its network and database to offer the Tenant properties that meet the specified preferences.
4.3. RNC Wonen is not liable for the unavailability of a suitable residential property (on time).
4.4. The Tenant is responsible for verifying whether the offered residential property meets their requirements and is free of defects.
4.5. In the case of a Rental Assignment, RNC Wonen will make efforts to find a suitable rental property outside its own portfolio, within and outside its existing network. The Rental Assignment is based on a no cure, no pay principle, meaning the Tenant only owes brokerage fees if a Lease Agreement is concluded.
4.6. The brokerage fee for the Rental Assignment is once the all-in rental price, excluding VAT.
Article 5: Liability and Limitation Period
5.1. RNC Wonen is not responsible for the accuracy of information provided by the Landlord. RNC Wonen is not liable for damages arising from inaccuracies or omissions in the information provided by the Landlord.
5.2. RNC Wonen is not liable for loss of data resulting from transmission via electronic communication methods.
5.3. RNC Wonen is not liable for the condition of the Residential Property or for it not meeting the expectations of the Tenant.
5.4. RNC Wonen is not liable for the actions or omissions of the Landlord and cannot be held responsible for the Landlord’s failure to fulfill obligations after the Lease Agreement has been signed.
5.5. If RNC Wonen is deemed liable for any damage, its liability is limited to the amount paid out by RNC Wonen’s insurer. If the insurance does not provide coverage, RNC Wonen's liability is limited to the amount of the Tenant’s first rent payment or, if not applicable, to one month's basic rent.
5.6. Any claim against RNC Wonen expires one year after the Tenant discovers the damage.
Article 6: Obligations of the Tenant
6.1. The Tenant must provide all requested data and documents to RNC Wonen in a timely and complete manner in connection with the Lease Agreement, Rental Service, or Rental Assignment.
6.2. The information provided by the Tenant must be correct and complete. Any errors or omissions are fully the responsibility and risk of the Tenant.
6.3. If RNC Wonen suspects that the provided information is incorrect or incomplete, this may result in the termination of services or withdrawal of the Lease Agreement by the Landlord, without the Tenant’s right to compensation.
6.4. The Tenant is responsible for obtaining any necessary housing permits and must ensure that these permits are obtained in a timely manner, before the Lease Agreement’s start date.
6.5. The Tenant is responsible for checking whether the Residential Property meets their preferences and is free of defects.
Article 7: Integrity, Confidentiality, and Privacy
7.1. RNC Wonen and the Tenant must act respectfully and with integrity towards each other. Both parties are required to keep confidential information private and use it solely for the intended purpose.
7.2. If RNC Wonen is legally obligated or ordered by a court to disclose confidential information to a third party, RNC Wonen is not required to provide compensation.
7.3. RNC Wonen processes personal data in accordance with the privacy policy available on RNC Wonen’s website.
Article 8: Applicable Law and Competent Court
8.1. Dutch law applies to the legal relationship between RNC Wonen and the Tenant.
8.2. Disputes between the Tenant and RNC Wonen will be submitted to the competent court in the district where RNC Wonen is located. The Tenant has one month after written notification from RNC Wonen to choose another court with jurisdiction according to the law.
